1. Acceptance of Terms

By downloading, accessing, or using Vita: Health Insights ("Vita"), you agree to these Terms of Use. If you do not agree, do not use Vita.

2. About Vita

With your permission, Vita reads Apple Health and HealthKit data and organizes it locally on your device into Health Context and reports. Vita is designed for information organization and personal reference only. It does not provide medical diagnosis, treatment, medical advice, or emergency medical services, and it must not replace advice from a qualified healthcare professional.

3. Health Data and User Responsibility

The availability, completeness, and accuracy of HealthKit data depend on Apple Health, connected devices, your permissions, and the completeness of recorded data. You decide whether and how to use, copy, or share Vita reports and are responsible for those choices. Consult a qualified healthcare professional about medical questions or concerns.

4. Premium Purchases

Vita Premium may be available through a monthly auto-renewable subscription, a yearly auto-renewable subscription, or a Lifetime non-consumable purchase. The products, prices, currencies, and offers available to you are those shown on the in-app purchase page and by the Apple App Store at the time of purchase.

5. Free Trials

Eligible monthly or yearly subscriptions may include a 7-day free trial. Apple determines eligibility. Unless you cancel before the trial ends, the subscription will renew automatically and your Apple Account will be charged for the selected plan. Trial and offer availability may vary by region, Apple Account, and prior use.

6. Auto-Renewal and Billing

• Payment will be charged to your Apple Account at confirmation of purchase.
• A subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• Your account may be charged for renewal within 24 hours before the current period ends.
• The renewal charge is based on your selected subscription plan.
• Apple handles billing and payment processing.

7. Managing and Cancelling Subscriptions

You can manage or cancel a subscription in your Apple Account or App Store subscription settings. Deleting Vita does not cancel a subscription. After cancellation, Premium access generally continues until the end of the current paid period. Vita cannot cancel an Apple subscription for you.

8. Lifetime Purchase

Lifetime is a one-time, non-consumable purchase and does not renew automatically. It may be restored using Restore Purchases with the same Apple Account, subject to Apple's transaction records and availability. “Lifetime” means Premium access to the current Vita app for as long as the app remains available; it is not a promise that the app, its developer, or any service will exist permanently.

9. Restore Purchases

You can use Restore Purchases in Vita. Restoration depends on use of the same Apple Account, an applicable Apple App Store transaction record, and a valid, verified entitlement.

10. Refunds

Apple processes all purchases. Refund requests are subject to the Apple Media Services Terms and Conditions and Apple's refund process. The Vita developer cannot directly approve or process App Store refunds.

11. Privacy

Vita is local-first and privacy-first. It does not require a Vita account or provide Vita-operated cloud synchronization. HealthKit access requires your permission, Vita does not automatically upload HealthKit data to a Vita server, and core reports are generated locally on your device. 12. Intellectual Property

Vita, its website content, branding, and related materials are protected by applicable intellectual property laws. You may not copy or redistribute them without authorization or present an unofficial product or service as affiliated with Vita.

13. Prohibited Use

You may not use Vita unlawfully; disrupt or interfere with the app; bypass purchase or access controls; attempt unauthorized access; or use Vita branding or content in a misleading manner.

14. Availability and Changes

Features may be updated, modified, or discontinued. Changes to HealthKit, Apple platforms, or other systems may affect Vita's operation. These Terms may also change. For material updates, this page will show a revised Effective Date.

15. Disclaimer and Limitation

Vita is provided on an “as is” and “as available” basis. Vita does not guarantee that HealthKit data will always be complete, error-free, or continuously available. To the extent permitted by applicable law, Vita and its developer are not liable for indirect, incidental, or consequential loss arising from use of, or inability to use, Vita. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under applicable consumer protection law.

16. Governing Terms for Apple Services

App Store purchases, subscriptions, and refunds are also governed by the Apple Media Services Terms and Conditions and applicable Apple policies. Where applicable, Apple's Standard Licensed Application End User License Agreement also applies.
